Judgement on a 43-year-old serial sex offender with murder and rape charges has been postponed to March 31st.
Rabidin Satir @ Rambo Bentong, is already serving a 133-year-jail term and was supposed to know yesterday his fate for allegedly raping and killing 17-year-old Annie Kok Yin Cheng in 2009.
High Court judge Abdul Karim Ab Rahman said that the facts of the case require further study as one of the exhibits contained the DNA of a third party. Rabidin, of Kampung Libang Ulu, Tambunan, Sabah, allegedly committed the crime at Lot 4168, Kampung Kentari, Bentong, between 11.30pm on March 7th, 2009 and 1.50pm the next day.
The murder charge, under Section 302 of the Penal Code, carries a mandatory death penalty upon conviction while the charge for rape, under Section 376 (4) of the same Act, carries death by penalty or a jail term of up to 30 years and whipping.
During the trial, defence attorney Richard Bong Chong Fook told the court that the chemist’s report revealed that a T-shirt of the victim contained third party DNA. He said no explanation was given and no statement was taken from the victim’s family members as to whom the DNA belonged to.
DPP Siti Hajar Mustaffa prosecuted.
The accused, who arrived in court under tight security, showed no emotion during the proceeding.
Rabidin was sentenced to 115 years and 50 lashes of caning on February 5th, 2013, after he pleaded guilty to four counts of rape and one count of unnatural sex between 2009 and 2011.
All four female victims were between eight and seventeen years old.
On March 21st, 2013, he was sentenced to 18 years of jail after pleading guilty to attacking and injuring police constable Mohd Suhaimi Md Razali, 24, with a parang at a house in Taman Shahbandar Husin, Bentong, at about 6pm on November 14, 2012.
