40-year-old restaurant manager Riduan Masmud denied raping a 13-year-old girl in a parked car along a road near the Kionsom waterfalls in Inanam between 9:00a.m. and 10:00a.m. on Febuary 18th, 2013.
The case was reported by the girl’s aunt and he was charged 10 days later but the teenager withdrew her report on April 18th this year.
He, who married the alleged rape victim, denied the charges against him in the Session Court and said that he had no idea how traces of his semen were found in the girl’s private parts. He also mentioned that it was unreasonable as traces of his semen was found in two pieces of handkerchiefs in the back seat of his car.
“I did not do it (rape her) and I don’t know how my semen could be found in these places mentioned by the court,” he said.
The manager, who has four children with another woman, also defended his marriage to the teenager saying that their marriage was consensual. The father of four claimed that he had sent his first wife to work at the 1Borneo Hypermall at about 9:45a.m. on the day of the incident and he could not have been at the crime scene.
It is learnt that they have known each other through Facebook for about three months and he fell in love with her after meeting her for a few hours on the same day the incident occurred. However, he claimed that they did not meet until their marriage at the Sabah Islamic Affairs Council office in May.
The alleged rapist also denied it when he was asked whether he married the teenage victim to have the rape charges against him withdrawn. He also claimed that he was preparing a wedding ring and a RM5,000 wedding dowry, as well as to have the teenager’s parents as his defence witnesses.
Her parents told the court that they consented to their child’s marriage to Riduan based on ‘suka sama suka’ (mutual love).
Kota Kinabalu Sessions Court judge, Ummu Kalthom Samad set January 2nd for Riduan’s submission and January 24th as the last day for defence.
