Earlier in August this year, Chuah Guan Jui, a 22-year-old electrician was released from his jail sentence on a RM25,000 bond for good behavior for three years by the Session Court after he was put in for raping an underaged girl. This underage was in fact his then girlfriend, and she was only 12 years old. He got away with this rape incident almost scot-free.
This entire situation called upon the women and civil rights groups which ofcourse we’re unhappy with the way this case was handle. On top of that, there was an explosion of rage through social media and news platforms regionally.
Today, local news have reported that the High Court in George Town, Penang have overturned their initial decision that was ordered over Chuah Guan Jiu to serve a jail term of five and a half years. That’s right, this rapist has finally been given the sentence he deserved.
Justice Datuk Seri Zakaria Sam, who imposed the final verdict upon Chuah Guan Jiu said, “You should know the risks under the law and be ready to face the consequences. You cannot claim consent in court. An adult like you having sex with a 12-year-old is a manipulator. She trusted you but you took advantage of her. Instead of sending her to school you took her home and had sex. In statutory rape, consent is irrelevant. A female under 16 is deemed incapable of giving consent under the law. Even if she had submitted, you knew she was underaged and had the choice to reject her”. (Source)
